General Terms and Conditions
Scope
These General Terms and Conditions apply to all written agreements for orders and bookings of restaurant premises, hotel rooms, and related additional services.
Contract Conclusion, Parties, Liability
The contractual partnership is valid between the contract signatories, who are the contracting parties.
For restaurant bookings, verbal ordering is sufficient.
Services, Prices, Payment
1. The hotel is obligated to provide the services ordered by the organizer and promised by the hotel.
2. The organizer is obligated to pay the prices agreed upon with the hotel for these services. This also applies to services and expenses of the hotel to third parties connected with the event.
3. The agreed prices include the respective statutory Value Added Tax (VAT).
4. Invoices are due for payment, without deduction, within 14 days of receipt of the invoice. In the event of default in payment, the hotel is entitled to charge default interest.
The law on speeding up due payments came into force on May 01, 2000. According to this, the debtor of a monetary claim automatically falls into default 30 days after the due date and receipt of an invoice and can then be immediately enforced in court. A formal reminder is no longer required. At the same time, the statutory default interest has increased to 9%.
Hotel's Right of Withdrawal
The hotel is entitled to withdraw from the contract for objectively justified reasons, for example if:
force majeure or other circumstances beyond the hotel's control make the fulfillment of the contract impossible;
events are booked under misleading or false information regarding essential facts;
the hotel has justified reason to believe that the event may jeopardize the smooth running of the business, the security, or the reputation of the hotel in public.
The organizer is not entitled to claim damages against the hotel, except in the case of willful misconduct or gross negligence on the part of the hotel.
Guest's Cancellation of a Reservation
1. In the event of withdrawal by the organizer/guest, the hotel is entitled to invoice the agreed services if the reserved premises/seats/rooms cannot be re-let.
2.1. Restaurant Booking up to 15 people: If the organizer withdraws up to 1 day before the event date, the cancellation is free of charge. If the organizer subsequently withdraws or reduces the number of people, we charge € 10.00 for each canceled seat.
2.2. Restaurant Booking from 15 people: If the organizer withdraws up to 4 weeks before the event date, the cancellation is free of charge. If the organizer subsequently withdraws, we charge € 20.00 for each canceled seat.
2.3. Restaurant Booking with Pre-ordered Food: If the organizer withdraws up to 4 weeks before the event date, the cancellation is free of charge. If the organizer withdraws up to 1 week before the event date, we charge € 20.00 for each reserved seat. If the organizer subsequently withdraws up to 1 day before the event date or reduces the number of people, we charge a pro-rata 50% of the ordered food. If the organizer subsequently withdraws or reduces the number of people, we charge a pro-rata 100% of the ordered food.
3. Hotel Booking: Should there be a change in the number of participants or a cancellation, written information is necessary.
We naturally endeavor to find alternative rental in the event of any cancellation.
**If re-letting occurs, the cancellation is free of charge, even at short notice!!!**
**Exceptions apply to external program items** (e.g., rail-bike tour)
which cannot be reimbursed if the costs remain chargeable to us.
In the event that re-letting is not possible, the cancellation invoice amount is calculated as follows:
Cancellations up to 2 people
Up to 1 week before the arrival date = free of charge
For less than 7 days, we charge:
Accommodation with Breakfast 80%
Accommodation with Half Board 60%
Accommodation with Program 60%
Cancellations from 2–6 people
Up to 2 weeks before the arrival date = free of charge
For less than 14 days, we charge:
Accommodation with Breakfast 80%
Accommodation with Half Board 60%
Accommodation with Program 60%
Cancellations from 6 people or more
Up to 8 weeks before the arrival date = free of charge
Between 8 and 3 weeks, we charge:
Accommodation with Breakfast 50%
Accommodation with Half Board 30%
Accommodation with Program 30%
For less than 21 days, we charge:
Accommodation with Breakfast 80%
Accommodation with Half Board 60%
Accommodation with Program 60%
Guests who do not arrive without informing the hotel are liable for 100% of the invoice amount.
For the New Year's Eve program, the cancellation conditions are as follows:
Cancellations up to 6 weeks before the arrival date = free of charge
For less than 6 weeks, we charge 60%
For less than 14 days, we charge 80%
For less than 7 days, we charge 100%
Bringing Food and Beverages
The organizer is fundamentally not permitted to bring food and beverages for consumption at the event. Exceptions require a written agreement with the banquet department. In such cases, a contribution to cover overhead costs will be charged.
Loss or Damage to Items Brought In
Personal items brought into the hotel are at the risk of the organizer. The hotel assumes no liability for loss or damage, except in cases of gross negligence or willful intent on the part of the hotel.
Final Provisions
1. Changes or additions to the contract, the acceptance of the application, or these General Terms and Conditions for events must be made in writing. Unilateral changes or additions by the organizer are invalid.
2. The place of performance and payment is the registered office of the hotel.
3. The exclusive place of jurisdiction—including for disputes concerning checks and bills of exchange—in commercial transactions is the registered office of the hotel. If a contractual partner meets the requirements of Section 38 Paragraph I of the German Code of Civil Procedure (ZPO) and has no general place of jurisdiction in Germany, the place of jurisdiction is the registered office of the hotel.
4. German law applies.
5. Should individual provisions of these General Terms and Conditions for events be ineffective or void, the validity of the remaining provisions shall not be affected. Otherwise, the statutory regulations apply.
